Within the parameters of contractual negotiations, IT providers and customers frequently take a lot of time to negotiate liability clauses. But just how important are liability clauses really? Are the time expenditures really worth it or would it make more sense to cleanly delimit the obligations and spheres of responsibility between the IT provider and the customer?
Attorney Jürgen Beckers takes the following position: “Liability clauses regulate only the legal consequences, but they don’t prevent liability”. In his speech, he shows why this is the case and which provisions in IT agreements will indeed reduce the liability risk of IT providers.
